These Terms & Conditions ("Terms") govern your use of the Traderbase marketplace and collection service operated by TRADEBASE (PTY) LTD ("Traderbase", "we", "us") at traderbase.co.za and our mobile apps. By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.

1. The service & our role

Traderbase is an online marketplace that lets users in South Africa buy and sell physical trading cards (such as Pokémon TCG cards) and track their collections. Traderbase only facilitates transactions between buyers and sellers. We are not the buyer or seller and are not a party to the contract of sale between users. The sale contract is concluded directly between the buyer and the seller. We provide the platform, the checkout, payment facilitation via our payment partner, and tools to help the transaction go smoothly.

4. Listings & reservations

When a buyer checks out, the relevant listing may be reserved for a limited period to allow payment to complete. If payment is not completed in time, the reservation expires and the item returns to sale. We may remove listings that breach these Terms or our policies.

5. Payments

Traderbase is card-only. Card payments are processed by our payment partner Paystack. By paying you also agree to Paystack's applicable terms. On successful payment, your order is confirmed and the seller is notified. Funds for an order are settled to the seller's account through Paystack's subaccount and settlement process. We do not store your full card details.

We may introduce or change fees in future. We will give reasonable notice and updated fees will apply only to transactions made after the change takes effect.

7. Shipping & delivery

Sellers are responsible for packaging items safely and shipping them tracked via a courier, with the waybill recorded on the order. Risk and delivery are matters between buyer and seller; Traderbase is not the carrier. See our Refunds & Returns policy for what happens if something goes wrong.

8. Prohibited items & conduct

You may not list counterfeit, fake, stolen, or misrepresented cards, or any item or content that is illegal or breaches our Acceptable Use Policy. We may remove listings and take enforcement action for breaches.

9. Disputes between users

If a transaction goes wrong, buyers and sellers should first try to resolve it directly through Traderbase messaging. Our limited role in mediation and escalation is set out in our Dispute Resolution policy.

10. Intellectual property

The Traderbase name, logo, software and design are owned by us. You keep ownership of the content you upload (such as listing photos) but grant us a non-exclusive licence to host, display and use it for operating and promoting the service. Card names and images may be trademarks of their respective owners; Traderbase is not affiliated with or endorsed by those owners.

11. Disclaimers & limitation of liability

The service is provided "as is". To the maximum extent permitted by law, and without limiting your rights under the Consumer Protection Act and other applicable South African law:

Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify Traderbase against claims, losses and costs arising from your breach of these Terms, your listings or content, or your transactions with other users.

13. Suspension & termination

You may stop using the service at any time. We may suspend or terminate access for breach of these Terms or our policies, or where required by law. Provisions that by their nature should survive (such as fees owed, liability and indemnity) survive termination.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date. Continued use after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. Your rights under the Consumer Protection Act, 2008 and the Electronic Communications and Transactions Act, 2002 are not affected.
